Illegal immigrant goes nuts on ICE officers

Three deportation officers trying to take an illegal immigrant into custody earlier this month suffered significant injuries after the man fought back, prosecutors said, describing a bizarre scuffle that included the migrant grabbing and twisting an officer’s testicles.

One of the other officers then grabbed the illegal immigrant’s testicles to get him to release his grip on the officer.

Francisco De-Jesus Morales, a Nicaraguan, is charged with assault that inflicted bodily injury on a federal officer.

The alleged attack is the latest in a growing string of incidents where migrants are resisting arrest by U.S. immigration and Customs Enforcement. The resistance appears to track with increasing anti-ICE rhetoric by immigration groups and congressional Democrats.

One officer involved in the May 2 incident suffered a stress fracture in his ankle and two others have missed work from the bruises and scrapes.

Nihad Custo, a Homeland Security Investigations agent, said in an affidavit justifying the charges that Mr. Morales is from Nicaragua and is in the country illegally. An immigration judge ordered him deported on March 3, but he didn’t show for his hearing, so he wasn’t taken into custody.

He has been out in the community, albeit under the supervision of ICE. He had been issued a phone to track his whereabouts.

ICE officers decided to take him into custody and had the contractor who ran the phone monitoring program call Mr. Morales in to return his phone in San Jose, California. That’s when an officer swooped in behind him and tried to handcuff him, Agent Custo said.

Mr. Morales pulled away, then smashed his elbow into the officer’s side, knocking him off balance. Mr. Morales then tried to flee the room, and two other deportation officers rushed to help.

They all tussled and fell to the ground, Agent Custo said, which is when the testicle-grabbing happened.

“Morales forcibly grabbed, squeezed, pulled, and twisted Deportation Officer C’s testicles. Deportation Officer C yelled, ’Let go of my balls!’ or words to that effect,” the agent recounted.

The other two officers began punching Mr. Morales, then the officer who originally tried to handcuff Mr. Morales grabbed him by the testicles.

“At that point, Morales released his grip on Deportation Officer C’s testicles,” Agent Custo said, adding that it ended the melee.

The first officer sustained a hairline fracture in his ankle. A second officer was bruised and scraped on his knees and chest. And the third officer “suffered significant bruising to his testicles and back.”

Mr. Morales had a cut and bruises on his face.
